KOLALUX TERMS OF SERVICE

These Terms of Service govern purchases from and use of the KOLALUX online store, operated by Kolanut Luxury (Pty) Ltd (“Kolalux”, “we”, “us” or “our”), South Africa.

1. Our Business

Kolalux is a luxury resale and retail business offering selected new, pre-owned, vintage and consigned goods. Products may include watches, handbags, accessories, jewellery and other luxury or collectible items.

2. Product Information and Condition

We make reasonable efforts to describe products accurately and to provide photographs and condition information that fairly represent each item.

Customers acknowledge that pre-owned and vintage goods may display signs of age, previous ownership, wear or restoration. Where reasonably identifiable, material condition issues will be disclosed in the product listing.

Product photographs form part of the product description. Colours and appearance may vary slightly depending on lighting, photography and the customer's device or display.

3. Authenticity

Kolalux does not knowingly offer counterfeit goods. Products represented as authentic are assessed using the information, expertise and/or third-party authentication resources reasonably available to us.

Where third-party authentication has been obtained, relevant authentication information may accompany the item or be retained in our records.

Nothing in these Terms limits a customer's rights where goods are materially misrepresented, counterfeit or otherwise fail to comply with applicable law.

4. Pricing

Prices displayed on the Kolalux website are stated in the currency indicated at checkout. Any applicable taxes, delivery charges or other costs will be displayed or communicated as required before completion of the transaction.

We may correct genuine pricing, description or administrative errors before an order is accepted or fulfilled. Where an error affects an order already placed, we will contact the customer and deal with the matter in accordance with applicable law.

5. Orders

Placing an order does not necessarily guarantee availability. Many Kolalux products are unique or one-of-a-kind and may also be subject to stock verification, consignment arrangements or prior sale.

Kolalux reserves the right, subject to applicable law, to decline or cancel an order where an item is unavailable, an obvious error has occurred, payment cannot be verified, fraud is reasonably suspected, or fulfilment is otherwise impossible. Where payment has already been received and the order cannot lawfully be fulfilled, an appropriate refund will be processed.

6. Payment

Customers must provide accurate billing and payment information. Payments are processed through payment providers made available through our online store. Kolalux does not require customers to provide payment-card information outside approved payment channels.

7. Delivery

Orders are delivered according to the shipping options displayed at checkout and our Shipping Policy. Delivery estimates are estimates rather than guarantees unless expressly stated otherwise.

Customers are responsible for providing a complete and accurate delivery address and appropriate contact information.

8. Risk and High-Value Goods

Kolalux may apply additional verification, delivery, signature or security procedures to high-value transactions where reasonably necessary to protect the customer, Kolalux and the goods.

9. Returns and Refunds

Returns, refunds and applicable cooling-off rights are governed by our Return & Refund Policy and applicable South African law.

10. Consigned Goods

Some products offered by Kolalux may be sold on behalf of third-party owners. This does not diminish the consumer rights applicable to a purchase made from Kolalux through our online store.

11. Intellectual Property

Unless otherwise indicated, the Kolalux name, original website content, photographs, graphics and other original materials are owned by or licensed to Kolalux and may not be commercially reproduced without permission.

Third-party trademarks and brand names appearing in product descriptions remain the property of their respective owners. Their appearance does not imply sponsorship, affiliation or endorsement unless expressly stated.

12. Prohibited Use

Customers may not use the Kolalux website for unlawful, fraudulent or abusive purposes, attempt to interfere with its operation, submit false information, or use the platform in a manner that infringes the rights of Kolalux or others.

13. Consumer Rights

Nothing in these Terms is intended to exclude, waive or restrict rights that cannot lawfully be excluded under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable South African law.

14. Changes

Kolalux may update these Terms from time to time. The Terms applicable to a transaction will be those in effect when the relevant order is placed, subject to applicable law.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with subject to applicable South African law and any rights a consumer may have regarding jurisdiction or dispute resolution.
