1. Registration:

• • Fee: A registration fee of R250 will be charged before participation at our auctions. The amount will be returned 24 hours after the auction is over and if the bidder does not purchase any items. All registration fees must be paid no later than 24 hours before the auction. Alternatively the bidder may choose to leave the registration fee if they intend to participate on an ongoing basis in our auctions
  • Requirements: Accurate personal information and agreement to terms and conditions

2. Bidding Process:

• • Platform: Online on our website
  • Conditions:
    • Bids are binding and cannot be retracted.
    • Each bid must adhere to the specified bidding increment.
    • The highest bid at the close of the auction wins the item.
    • The auctioneer reserves the right to reject any bid deemed unreasonable or suspicious.
  • Disputes: Any disputes between bidders shall be settled at the auctioneer’s discretion.

3. Payment:

• • Methods: Cash, credit card (excluding American Express and Diners Club), or bank transfer No cash for online auction
  • Deadline: Full payment is due within five (5) working days after the auction. No goods will be collected /couriered unless they are paid in full and listed on the Kolanut Luxury invoice
  • Collection: Monday – Friday, 8:30 AM – 4:30 PM. Items not collected within 1 month will be resold to defray expenses, and the buyer will be responsible for any losses incurred.

4. Goods and Conditions:

• • Inspection: Buyers must inspect items before bidding. Contact us for condition reports.
  • As-Is Sale: All items are sold “voetstoots” (as they are), and the auctioneers are not liable for any damage or deficiency.
  • Descriptions: Items are accurately described, including any defects or wear. Photos accompany descriptions for visual confirmation.
  • Liability: The seller is not responsible for errors in sizes and conditions. Buyers accept goods as they stand with all faults.
  • Authenticity:  The seller is solely responsible for the authenticity and accuracy of the items they submit for auction, as not all items belong to KOLALUX. We make no representations or warranties regarding the authenticity, provenance, or condition of any items.

5. Additional Fees:

• • Commission: A 15% commission on all goods, plus 15% VAT on the commission, payable by the purchaser.

6. Auctioneer’s Rights:

• • Reserve Price: Some items may have a reserve price. The auctioneer may bid on behalf of the vendor up to the reserve price.
  • Lot Adjustments: The auctioneer may divide, combine, or withdraw lots at their discretion.
  • Extension: The auctioneer can extend the auction period for any reason.
  • Dispute Resolution: Any disputes or discrepancies are resolved at the auctioneer’s discretion.

7. Buyer’s Responsibilities:

• • Packaging and Transport: Buyers are responsible for packaging and transport costs. Kolalux staff may assist as a courtesy, and packaging materials are available for a fee.
  • Collection: Removal or collection of items will be no later than five (5) days after the auction. Any item(s) left will be sold on the following auction or a storage fee of R500 per item, per day will be levied 
  • Risk: At the fall of the hammer, any lot(s) remain at the risk and expense of the purchaser. The seller is not liable for any damage to the purchaser’s goods.
  • Non-Payment: If the purchaser defaults in payment, the lot(s) may be resubmitted for future sale at the defaulter’s risk without reserve. The defaulter remains liable for the purchase price, and no goods may be returned.

8. Legal and Additional Conditions:

• • Jurisdiction: The parties’ consent to the jurisdiction of the Magistrates Court in terms of Section 45 of Act 32 of 1944 as amended. The seller can institute action in any other competent court.
  • Address for Service: The provided address is used for any legal proceedings arising out of this contract.
  • Authenticity Certificates: Issued and emailed on request.
  • Legal Costs: The purchaser is liable for costs on a scale between attorney and client in any legal proceedings from this contract or invoice.
  • Governing Law: The auction is governed by the laws of South Africa. Any disputes will be resolved according to these laws.
  • Amendments: The auctioneer reserves the right to modify or update the terms and conditions at any time. Participants will be notified of changes, and continued participation implies acceptance of the revised terms.

9. Privacy Policy:

• • Confidentiality: Personal information collected during registration will be kept confidential and used only for auction-related purposes.
